Incentive Trust Planning

"One of our sons has always been bad with money. When we did our estate plan, we didn't know what to do with him. We just knew that we couldn't give him anything because it would go to alcohol and cigarettes.

More on Incentive Trusts

Have you ever seen the movie “The Ultimate Gift?” If so, you might have a general idea of what an incentive trust could look like. The general idea of an incentive trust is to motivate or “incentivize” certain behaviors and/or discourage undesirable behaviors by making the receipt of assets contingent upon compliance with or forbearance from those behaviors.
For example, you might want to tie the receipt of certain assets to:
  • Educational achievement
  • Health standards (no drugs or alcohol, regular exercise, no tobacco use, etc.)
  • Moral standards
  • Playing a certain role in a family business or venture
  • Philanthropic activities
While all of these might sound like good ideas, incentive planning can sometimes breed resentment, overlook other needs, or unnecessarily restrict funds. We can discuss the pros and cons of incentive trusts and help you avoid any pitfalls. Give us a call at (855) 335-1060 to find out if an incentive trust would be right for you and your posterity
